Hearings and Appeals:

If you have received one of the following documents, you have the right to a Hearing or an Appeal before the Board of the Alcohol and Gaming Commission of Ontario (the Board).

A Notice of Proposal (NOP); or
A Notice of Proposed Order (NOPO); or
An Order of Monetary Penalty (OMP Alcohol); or
An Order of Monetary Penalty (OMP Gaming)

In its adjudicative function, the Board deals with appeals and applications in the areas of liquor and gaming-related matters across the province. The Board hears evidence to make decisions on the merits of each case completely independent of all parties, including the Registrar of Alcohol and Gaming (the Registrar), the inspectors and investigators.

The Board is supported by the Hearings Department whose staff is neutral and impartial. The Hearings Department provides support services to the Board and Chair of the Alcohol and Gaming Commission of Ontario (AGCO) who hear these cases. They arrange hearing and appeal dates, provide summonses for witnesses, and communicate with you about other hearing or appeal related matters. Hearings Department staff do not speak on behalf of the Registrar and cannot speak on your behalf to Registrar’s counsel. They cannot give you legal advice.

If the Registrar is seeking to refuse, revoke or suspend your licence/registration, or ordering a monetary penalty and you wish to appeal the NOP/NOPO, you must request a hearing before the Board within fifteen (15) days of receiving the NOP/NOPO. If you wish to appeal the Order of Monetary Penalty (OMP), you must file an Appeal before the Board within fifteen (15) days of receiving the OMP. Hearing Location and Services:

Hearings/appeals are held throughout the province, including the hearing rooms located at 90 Sheppard Avenue East, Suite 300, Toronto (AGCO head office). Notices of hearings/appeals will be sent at least ten (10) days before the hearing/appeal date.

Advise the Hearings Department as soon as possible if you would like your hearing or appeal conducted in French. The Board provides interpretation services in French, English and American Sign Language.  The Board’s Toronto hearing rooms are fully wheelchair accessible and every effort is made to hold hearings in wheelchair accessible locations outside of Toronto.
